Between User and Wheatear Travels LLP

APPLICABILITY :

The User must be at least 18 years old and possess the legal authority to enter into an agreement to become a User and utilize WT’s services. If you are a minor or under the age of 18, you are not permitted to register as a User of the Website, nor are you allowed to transact on or use the Website.

If you are a minor and wish to use or transact on the Website, such use or transaction must be conducted by a person of legal contracting age (a legal guardian or parent). We reserve the right to terminate your membership and/or block access to the Website if it is discovered that you are a minor, legally incompetent to contract, or if any information regarding your age provided during account creation is false.

Before using the Website, engaging with any Sales Channels, or utilizing WT’s services, Users must read and understand this User Agreement. By doing so, Users are deemed to have accepted this User Agreement as a binding document governing their dealings and transactions with WT. If the User does not agree with any part of this Agreement, they must not use WT’s services or access any of WT’s Sales Channels.

All rights and liabilities of the User and WT regarding any services or products facilitated by WT are confined to the scope of this User Agreement.

ELIGIBILITY TO USE :

This User Agreement, along with the Terms of Service (collectively, the “User Agreement”), constitutes the terms and conditions for utilizing the services and products provided by Wheatear Travels LLP (“WT”).

Any individual (“User”) who inquires about or purchases WT’s products or services through its websites, mobile applications, sales representatives, offices, call centers, branch offices, franchisees, or agents (collectively referred to as “Sales Channels”) agrees to abide by this User Agreement. WT’s websites and mobile applications are collectively referred to as the “Website.”

Each User and WT are individually referred to as a “Party” and collectively as the “Parties” under this User Agreement.

The “Terms of Service” available on WT’s website specify the terms and conditions applicable to various services or products facilitated by WT. Users should consult the relevant Terms of Service for the specific product or service they have booked. These Terms of Service are binding on the User.

LIMITED LIABILITY OF WT :

WT acts as a facilitator, connecting Users with service providers like airlines, hotels, restaurants, and bus operators (collectively “Service Providers”), unless explicitly acting as a reseller. WT’s liability is limited to providing Users with confirmed bookings.

Any issues or concerns during the use of these services are the sole responsibility of the Service Provider. WT is not liable for any acts, omissions, errors, representations, warranties, breaches, or negligence by any Service Provider.

    Unless explicitly stated by WT:

  • WT assumes no liability for the quality of services provided by Service Providers.
  • WT does not guarantee the quality or fitness of services as represented.
  • WT does not guarantee the availability of services listed by Service Providers.

By making a booking, the User acknowledges that WT only provides a technology platform for booking services and products, with ultimate responsibility resting on the respective Service Provider.

Users also understand that information on the Website is provided by the Service Provider, and WT is not liable for any inaccuracies, inadequacies, or outdated information, or any legal contraventions in the provided information.

SECURITY AND ACCOUNT INFORMATION :

When registering on the Website, the User must create a password to access their account. The User is solely responsible for keeping both the password and the account secure and for all activities that occur under their account. If there is any unauthorized use of the User’s password or account, or any other security breach, it is the User’s responsibility to notify WT immediately in writing. WT will not be liable for any loss resulting from unauthorized use of the password or account, whether or not the User is aware of such use. The User must not use another person’s account at any time.

The User acknowledges that any information provided on the Website could be read or intercepted by others due to a security breach on the User’s end.

WT ensures that all data related to credit cards, debit cards, and bank information is kept secure and encrypted in accordance with applicable laws and regulations. However, for purposes such as fraud detection or offering credit for bookings, WT may verify certain User information, including credit scores, as needed.

WT may also share Personal Information in an anonymized and/or aggregated form with third parties engaged to perform specific tasks on its behalf, such as payment processing, data hosting, data processing, and assessing creditworthiness for offering bookings on credit, in compliance with applicable laws.

WT uses industry-standard practices to secure the information provided by the User. However, WT cannot guarantee the absolute security of its systems, and a security breach could impact the User’s information.

User data held by WT may be shared with law enforcement agencies for lawful or investigative purposes without the User’s consent.

FEES AND PAYMENT :

In addition to the booking costs charged by Service Providers, WT may levy convenience or service fees. WT reserves the right to adjust these fees periodically. Any additional fees, including those for modifications, will be displayed to the User before finalizing the booking or collecting payment.

If there is a shortfall in the booking amount, taxes, statutory fees, convenience fees, etc., due to technical errors or other reasons, WT reserves the right to claim the balance amount from the User, who must then pay the difference. If this shortfall is identified before the booking is utilized, WT may cancel the booking if the amount is not paid before the utilization date.

Any increase in fees due to changes in tax rates or new taxes imposed by the government must be borne by the User. These changes can be retroactive and without prior notice but will comply with applicable laws.

If a booking is not confirmed for any reason, WT will refund the booking amount to the User and inform them. WT is not obligated to provide an alternate booking or compensate for the unconfirmed booking. Any subsequent bookings will be treated as new transactions. Refunds will be processed according to the policies of the Service Provider and WT.

The User is responsible for all charges, fees, duties, taxes, and assessments arising from using the service, per applicable laws.

The User agrees that payments should only be made to WT’s official bank accounts. WT will never request a transfer to a private account. If a User transfers money to an unofficial or personal account, WT will not be liable. Users cannot claim any recovery from WT for such transactions.

The User should not share sensitive information like credit/debit card numbers, CVV, OTP, card expiry dates, user IDs, or passwords with anyone, including WT’s agents, employees, or representatives. If such details are requested, the User should inform WT immediately. WT will not be liable for any loss incurred from sharing this information.

Refunds for canceled bookings will be processed to the original payment method used for the booking.

Bookings made through WT are subject to the cancellation policy provided on the booking page or communicated in writing.

WT offers various payment methods on the Website, including UPI, credit/debit cards, net banking, wallets, gift cards, and EMI options.

INSURANCE :

Unless explicitly stated by WT for a specific service or deliverable, it is the User’s responsibility to obtain adequate insurance coverage. WT will not accept any claims related to insufficient insurance coverage.

If insurance is included as part of a WT service or product, it will be governed by the terms and conditions of the third-party insurance provider. WT acts only as a facilitator, connecting the User with the insurance company. For any claims or disputes, the User must directly contact the insurance company. WT will not be liable for any partial acceptance or denial of claims by the insurance company.

TCS Compliance for Overseas Tour Packages:

An 'Overseas tour package' refers to any package facilitating travel to countries outside India, covering expenses like travel, accommodation, boarding, or similar expenditures.

A 'Specified Person' is defined under Section 206CCA(3) of the Income Tax Act, 1961.

Users are liable to pay Tax Collected at Source (TCS) on the booking of an 'Overseas tour package' at the prescribed rate, in addition to the package price, as per Section 206C (1G)(b) of the Income Tax Act, 1961. WT will collect and remit this TCS to the Government, issuing the necessary documents to users in compliance with these provisions.

Users must provide their valid PAN details at the time of booking. WT will verify the PAN provided to ensure compliance with Section 206CC of the Income Tax Act. Non-compliance or invalid PANs may lead to booking cancellation, with refunds processed according to the applicable cancellation policy.

Additionally, WT will verify PANs under Section 206CCA of the Income Tax Act. If the user qualifies as a 'Specified Person' upon verification, they must pay TCS at the higher applicable rate. Failure to pay may result in booking cancellation, with refunds handled as per the cancellation policy.

COMPLIANCE WITH LIBERALIZED REMITTANCE SCHEME (LRS):

The RBI requires PAN details for all transactions under the Liberalized Remittance Scheme (LRS), including any international bookings made on the Website or through Sales Channels. The User guarantees that the PAN details for the User/traveler will be provided by the prescribed cut-off date set by WT, either at the time of booking or afterward. If the traveler is a minor, WT will require the PAN details of the parent or guardian. Failure to comply may result in the cancellation of the booking.

The User also confirms that the total amount of foreign exchange purchased or remitted during the current financial year from all sources in India, including the current transaction, falls within the RBI’s permissible limit. If this limit is exceeded before the actual remittance request is approved by the AD Bank, WT must cancel the booking in compliance with the law and process a refund according to the applicable cancellation policy. The User further confirms that any foreign exchange purchased for the purpose of international travel under the current booking will be used for the stated purpose.

The User authorizes WT to retrieve the User’s/traveler’s (if booking on someone’s behalf) PAN details from the User’s profile or previous bookings, or to share the User/traveler’s data with third parties for collecting or verifying PAN details solely for the purposes mentioned in this Agreement.

WT does not collect PAN details without the User’s consent. If the User wishes to opt-out of providing PAN details or wants to delete them if already provided, they can do so through the profile information on the Desktop.

The User authorizes WT to share User/traveler data with third parties for collecting or verifying PAN details.

VISA REQUIREMENTS:

International bookings made through WT require the User to comply with visa requirements, including transit visas and OK TO BOARD, based on the travel itinerary and the destination countries.

WT bears no responsibility for any issues arising from visa requirements, including travel inability. WT does not refund any amount if the User cannot utilize the booking due to visa absence or denial, regardless of whether WT assisted in the visa process. Any refunds will adhere to the applicable booking terms and cancellation policy.

RIGHT TO REFUSE:

RIGHT TO REFUSAL BY WT:

WT reserves the right to reject any booking at its sole discretion without providing reasons.

WT will only provide services or share confirmed booking details once complete payment is received from the User.

In addition to other remedies available under this User Agreement or applicable law, WT may take actions such as limiting the User’s activity, warning other users, suspending or terminating the User’s registration, or denying access to the Website if:

  • The User breaches this User Agreement;
  • WT cannot verify or authenticate the User’s provided information;
  • WT believes the User’s actions may infringe on third-party rights, violate any law, or result in liability for the User, other WT users, or WT itself.

Suspended or terminated Users may not attempt to register with different credentials or use the Website until reinstated by WT, at its discretion.

If a User breaches this Agreement, WT reserves the right to recover any owed amounts and take appropriate legal action.

The User agrees not to send or communicate with WT in any manner that is:

  • Abusive, threatening, offensive, defamatory, coercive, obscene, belligerent, glorifying violence, vulgar, sexually explicit, pornographic, illicit, or objectionable;
  • Contrary to any applicable law;
  • Infringes on third-party intellectual property rights;
  • Spam; or
  • In breach of any other terms and conditions.

WT reserves the right to take legal action against Users who violate these terms.

RIGHT TO REFUSAL BY END SERVICE PROVIDER:

The User acknowledges that the end service provider may refuse to provide agreed services for any booking made through WT, with or without reasons. Reasons may include behavioral issues, public safety concerns, health hazards, infectious diseases, government orders, or notifications.

In cases of service refusal, any resulting liability rests solely with the end service provider, outside the purview of WT. The User agrees that any claims, refunds, or damages resulting from such refusal shall be solely against the end service provider and not WT.

RIGHT TO CANCEL:

The User agrees to provide WT with accurate and valid information when using the Website under this User Agreement and pledges not to misrepresent any facts. Any misrepresentation by the User will disqualify them from availing WT’s services.

If WT discovers or suspects, at any time during or after receiving a service request from the User, that the request is unauthorized or that the information provided by the User or any traveler is incorrect or misrepresented, WT reserves the right to take appropriate legal action against the User. This may include canceling bookings without prior notice to the User. WT will not be liable for any loss or damage resulting from such cancellation of bookings or services to the User or any other person involved in the booking.

If any judicial, quasi-judicial, or government authority requests WT to cancel a booking, WT will comply without contacting the affected User beforehand.

The User agrees not to hold WT responsible for any loss or damage resulting from actions taken by WT to protect its own interests and those of its genuine customers. This includes WT denying or canceling bookings due to suspected fraudulent transactions.

FRAUDULENT ACTIVITIES AND PHISHING:

WT’s employees or authorized representatives will never request a User’s credit or debit card number, expiry date, CVV, net banking login, passwords, OTP, or any form of fund transfer to a personal or individual bank account. They will also not ask Users to install third-party applications that allow access to a User’s mobile or computer screen.

Responding to such requests can make you vulnerable to fraud, potentially resulting in financial loss or compromise of sensitive information.

INDEMNIFICATION:

The User agrees to indemnify, defend, and hold harmless WT, its affiliates, and their respective officers, directors, legal successors, and assigns from any and all losses, liabilities, claims, damages, costs, and expenses (including legal fees and disbursements, as well as interest charges) asserted against or incurred by such indemnified parties. These may arise from any breach of representation or warranty made by the User, or from any failure to fulfill any obligation by the User.

The User is solely responsible for complying with country-specific rules, regulations, and general codes of conduct. WT cannot be held accountable for any breaches thereof.

COVID-19 RELATED TERMS & CONDITIONS::

Due to the recent outbreak of the COVID-19 pandemic, declared a national disaster by the Government of India, the User acknowledges that the end service provider may cancel bookings or refuse services without specifying reasons. Reasons for refusal may include but are not limited to:

  • Displaying symptoms associated with COVID-19.
  • Non-compliance with safety advisories such as wearing protective gear and maintaining social distancing.
  • Vulnerability to the virus due to underlying health conditions.
  • Posed threat to the health and safety of others.

WT bears no liability for service refusal by the end service provider in such cases. The User agrees that any refunds for affected bookings will be processed by WT upon receipt from the end service provider.

The User also acknowledges that due to the COVID-19 outbreak, the Central Government, State Governments, and statutory bodies have or may issue detailed guidelines or standard operating procedures (SOPs) for travelers. The User agrees to adhere to all such guidelines/SOPs during travel. Failure to comply may result in the service provider or authorized personnel disallowing travel. WT will not be liable for such travel restrictions, and any refunds will strictly adhere to the service provider’s terms.

Furthermore, the User understands that the Central Government, State Governments, and other bodies may mandate downloading the Arogya Setu App or submitting a self-declaration form before entering transit points like airports or railway stations, or during check-in at hotels. The User must ensure compliance by downloading the Arogya Setu App on their smartphone or providing alternate documentation as required.

The User agrees that all bookings are subject to minimum medical wellbeing criteria set by the Government or appropriate authorities. For inbound travel, especially, the User must certify no medical history of COVID-19 within 28 days before the scheduled travel date. Documentation such as a health declaration in the prescribed format may be required as per applicable regulations.

MISCELLANEOUS:

SEVERABILITY:

If any provision of this User Agreement is found to be invalid or unenforceable in whole or in part, only that specific provision or part thereof shall be deemed invalid or unenforceable. The remainder of the provision and all other provisions of this User Agreement shall remain fully enforceable.

JURISDICTION:

This Agreement shall be governed by the laws of India, and any unresolved disputes shall be exclusively referred to the courts in Kolkata.

AMENDMENT TO THE USER AGREEMENT:

WT reserves the right to modify the User Agreement periodically. It is the User’s responsibility to regularly review the User Agreement.

CONFIDENTIALITY:

Any information designated as confidential by WT must be maintained in confidence by the User and shall not be disclosed except as required by law or for fulfilling the obligations under this User Agreement.

FEEDBACK FROM CUSTOMERS:

WT values User feedback to enhance its services. By using the Website, the User consents to WT contacting them for feedback via email, phone calls, SMS, or other mediums. Users may opt out of such communications by contacting WT at enquiry@wheateartravels.com.

PRIVACY POLICY:

Users must refer to WT’s Privacy Policy available on the Website, governing its use. By using the Website, Users consent to the Privacy Policy terms and agree to WT and its affiliates using their personal information accordingly.

FLIGHT TICKETS

TERMS OF THE AIRLINES:

Flight tickets purchased via the Website are subject to the terms and conditions of the respective airlines, including cancellation and refund policies.

ROLE OF WT:

WT acts solely as a facilitator enabling Users to book flight tickets. The service contract for flight usage remains exclusively between the User and the airline concerned.

AIRLINE’S RIGHTS:

Airlines reserve the right to reschedule flight timings, change routes, or cancel flights without prior notice to WT. WT assumes no liability for any direct or incidental losses incurred by Users due to such changes or flight cancellations.

VARIED TICKET RESTRICTIONS:

Different tickets on the same airline may impose varying restrictions or offer different services and prices.

BAGGAGE ALLOWANCE:

Baggage allowances are determined by the airline’s terms. Some fares displayed are for “hand baggage only,” necessitating separate payment for check-in baggage. Prices for adding check-in baggage vary by airline; Users are advised to contact airlines for details.

CODE SHARE:

Certain airlines participate in “code share” agreements with others. This means the flight may be operated by a partner airline not listed on the ticketing carrier. WT discloses such code-share arrangements when disclosed by the ticketing airline

PRICING:

The total price displayed on the payment page includes base fare, applicable government taxes, and a convenience fee. Users must pay the entire amount before booking confirmation. Failure to pay may result in booking cancellation. Users agree to pay all applicable taxes, surcharges, and fees at the time of travel.

INFANT FARES:

To qualify for infant fares, the child must be under 24 months old throughout the itinerary. For return journeys where the child is 24 months or older, a separate booking using child fares is required. Infants and children must be accompanied by an adult as per airline regulations.

TRAVEL DOCUMENTS:

Users are solely responsible for possessing valid travel documents (identity proof, passport, visas) necessary for travel. WT is not liable for inability to travel due to insufficient travel documents.

ADVISORY NATURE OF INFORMATION:

Information provided by WT regarding travel documents is advisory and not conclusive. Users must confirm travel requirements with airlines and jurisdictions they transit through or visit.

CHECK-IN TERMS:

Users should verify check-in times directly with airlines. Typically, check-in opens 2 hours before domestic flights and 3 hours before international flights.

IDENTIFICATION REQUIREMENTS:

Users must carry valid identification and age proof for all passengers, including infants, as required by airlines.

USE OF FLIGHT SEGMENTS:

Non-boarding on the outbound journey will result in automatic cancellation of the entire PNR by the airline. WT has no control over this process and is not obligated to provide alternate bookings. Cancellation penalties apply per airline rules.

CHANGES TO EXISTING BOOKING:

Changes to existing bookings are subject to airline charges and WT service fees.

REFUNDS:

Refunds are processed per airline fare rules and policies. WT facilitates refunds upon receipt from airlines. Convenience fees paid to WT at booking are non-refundable.

CHARTER

TERMS OF THE CHARTER COMPANY:

Charter bookings via the Website are subject to terms and conditions of the respective Charter Company, including cancellation policies.

ROLE OF WT:

WT facilitates charter bookings, acting solely as a facilitator. The service contract for charters remains exclusively between the User and the Charter Company.

CHARTER COMPANY RIGHTS:

Charter Companies may cancel or reschedule bookings due to weather conditions, operational requirements, or unforeseen technical issues. Alternate arrangements depend on availability and are at the discretion of the Charter Company. Fare differences apply during rescheduling.

ON-BOARD FACILITIES:

Luggage allowances, boarding, lodging, and other services are per the Charter Company’s terms. WT may assist in communicating User requests to the Charter Company, but fulfillment is solely at the Charter Company’s discretion.

CHANGES TO EXISTING BOOKING:

Changes to charter bookings are subject to Charter Company charges.

TRAVEL DOCUMENTS:

Charter Companies require passenger information well in advance for security clearances. WT is not liable for travel denial due to inadequate documents or refusal to board.

REFUNDS:

Refunds follow Charter fare rules and policies. Convenience fees paid to WT at booking are non-refundable.

HOTELS

ROLE OF WT AND LIMITATION OF LIABILITY:

WT acts as an online platform for Users to select and book hotels. All hotel information (category, images, amenities) is provided by hotels to WT. Discrepancies between website images and actual settings must be resolved directly with the hotel; WT assumes no liability in this regard.

HOTEL BOOKING VOUCHER:

The voucher is based on information provided by the hotel regarding inventory availability. WT is not liable for hotel failure to accommodate confirmed bookings, service standards, or any related issues. Liability in case of check-in denial is limited to providing alternative accommodation or refunding the booking amount.

HOTEL ADMISSION POLICIES:

Hotels reserve the right of admission. WT has no influence over admission decisions based on policies such as restrictions on unmarried couples or local residents. No refunds apply for denied check-in under such circumstances.

USER RESPONSIBILITIES:

Users are liable for damages caused to hotel property by themselves or their guests. The primary guest must be at least 18 years old. Valid identity and address proof must be presented at check-in.

CHECK-IN POLICIES:

Check-in/check-out times and changes are per hotel policies. Early check-in or late check-out requests depend on availability and may incur additional charges.

ADDITIONAL CHARGES:

Bookings cover stay; additional services (meals, laundry, etc.) are paid directly to the hotel. Hotels may levy mandatory meal surcharges during festivals; such charges must be settled directly with the hotel.

PAYMENT TERMS:

Hotels offer “Prepaid” or “Pay at Hotel” options. In “Prepaid” bookings, full payment includes reservation rate, taxes, service fees, and any additional fees by WT. Correct credit or debit card details must be provided; WT may cancel bookings due to incorrect details.

In “Pay at Hotel” bookings, payment is collected by the hotel at check-in. International payments are in local or other currency as decided by the hotel. Correct credit or debit card details must be provided; WT may cancel bookings due to incorrect details.

Bus Services

Role of WT WT operates solely as a technology platform connecting travelers with bus operators. It does not operate buses or provide transportation services. Additionally, WT does not act as an agent for any bus operator during the provision of its platform services.

The bus ticket booking voucher issued by WT is based exclusively on seat availability information provided or updated by the bus operator.

Details such as amenities, services, routes, fares, schedules, bus types, seat availability, and any other relevant information regarding bus services are provided by the respective bus operators. WT has no control over the accuracy or completeness of this information provided by bus operators.

    Limitation of WT’s Liability In its role as a technology platform, WT is not liable for any aspects of bus operations, including:
  • Timeliness of bus departures or arrivals.
  • Conduct of bus operator’s employees, representatives, or agents.
  • Condition of buses or seats not meeting customer expectations.
  • Trip cancellations for any reason.
  • Loss or damage to customer baggage.
  • Reassignment of customer seats by the bus operator.
  • Incorrect boarding point information or subsequent changes without notification to WT or the User.
  • Use of separate vehicles by the bus operator for boarding.

User Responsibilities Users are advised to contact the bus operator directly to confirm boarding details or any other necessary information related to their trip. At the time of boarding, Users must present a copy of their ticket and a valid identity proof such as Aadhar card, passport, PAN card, voter identification card, or any other government-issued ID. Users should arrive at the boarding point at least 30 minutes prior to the scheduled departure time. All issued tickets are non-transferable. When accompanied by a child over 5 years old, Users must purchase a bus ticket at the regular fare, unless otherwise specified in the terms and conditions of the specific bus operator.

Train Services

Role of WT WT facilitates train ticket bookings and provides a platform for users to search and book train tickets through IRCTC. All bookings made via WT are subject to Indian Railways’ Terms & Conditions. WT has no control over the booking process, scheduling, cancellations, seat allocations, meal preferences, berth preferences, or any other service-related issues. Liability for these matters lies with Indian Railways. User Responsibilities During the e-ticket booking process, customers will be redirected to the IRCTC website/app to enter their IRCTC login credentials. Passengers must remember their IRCTC username and password to book trains via WT. E-tickets are issued solely by Indian Railways. Users can book a maximum of 6 seats/berths per booking, with seat/berth allocation based on Indian Railways’ logic. Only passengers with confirmed e-tickets are permitted to board the train. Passengers must carry valid ID proof during travel or when boarding the train. For all booking-related queries, users should visit www.irctc.co.in or http://www.indianrail.gov.in.

Activities and Other Services

Definitions ‘Activities’ encompass day tours & sightseeing, spa & wellness, adventure sports, cruises, theme/amusement parks, buffets & dining, or any other service/product available on the website. The provider of the Activity is referred to as the ‘Activity Provider,’ solely responsible for delivering the products/services booked by the User. Role of WT and Limitation of Liability WT’s role is limited to facilitating the procurement of Activity services between the User and the Activity Provider. The transaction/service fulfillment relationship is strictly between these parties. WT does not provide pick-up or drop-off services for any Activity unless explicitly stated in the reservation confirmation.

    WT is not liable for:
  • Any loss, injury, accident, delay, cancellation, or other service deficiencies caused by the Activity Provider.
  • User health, safety, or well-being during or after participating in the Activity.
  • Any ancillary services purchased directly from the Activity Provider.
  • Accuracy of information provided by the Activity Provider.

WT’s maximum liability is limited to refunding the booking amount received for the Activity. User Responsibilities Users agree to comply with both WT’s User Agreement, Terms of Service, and any terms set forth by the Activity Provider. Users must present the booking/confirmation voucher issued by WT to avail the Activity. Users must possess valid documents (ID proof, address proof, passport for international activities) as specified by the Activity Provider to participate. For any concerns post-booking, Users should contact the Activity Provider directly. Users must meet all eligibility criteria for the Activity, including age limits, weight limits, or medical conditions. Payments, Bookings, and Cancellations Activity reservations are subject to cancellation and refund policies set by the Activity Provider. WT may apply applicable taxes, service charges, convenience fees, etc., where applicable.

Visa Services

Role of WT and Limitation of Liability WT functions solely as a facilitator for visa processing and bears no responsibility for the approval or rejection of User(s) visas. The decision to issue a visa rests entirely with the relevant Embassy.

WT’s services should not be construed as visa advisory or consultancy; it acts solely upon User instructions. Users are responsible for understanding visa requirements for their intended travel destinations and instructing WT accordingly to initiate visa applications.

WT’s role is limited to informing Users about the documentary requirements for specific visa applications, collecting documents provided by Users, and submitting them to the respective embassy or high commission. Requirements for visa applications (including documentation, fees, and timelines) are based on information provided by the respective embassy or high commission. WT does not provide advice on document completeness, suitability, or the likelihood of visa approval or rejection.

WT may provide average processing times for visa applications by embassies or high commissions. However, Users are responsible for timely visa application submission to ensure visa issuance before their departure date.

Each country has varying passport and visa requirements, such as minimum blank pages or validity periods, established by the respective countries and subject to change without notice. While WT endeavors to provide accurate and updated information, discrepancies may occur due to the unavailability of information provided to WT, for which WT cannot be held responsible.

Visa approval or rejection is at the sole discretion of the respective embassy or high commission processing the visa application. Factors influencing approval include User-provided information, nationality, application location, residence, gender, age, profession, recent travel history, and religion.

Embassies or high commissions may require Users to attend face-to-face interviews at their discretion, which WT facilitates by informing Users of interview details as communicated by the respective embassy or high commission.

For visa applications requiring passport submission, WT takes precautions to ensure safe delivery to Users. However, WT is not liable for passport loss during transit or mishandling by logistics service providers.

The list of countries where visa application services are offered is available on WT’s desktop site and mobile app, subject to change at WT’s discretion.

WT is not liable for consulate, embassy, or authority acts or omissions causing visa delays or non-issuance, nor for incidental expenses incurred by Users. Even if a visa is issued, local immigration authorities have final authority on entry decisions, which WT cannot influence.

Certain countries may require additional conditions, such as “OK TO BOARD” approval for travel to Dubai. WT acts solely as a facilitator between Users and concerned airlines/departments for “OK TO BOARD” applications. Users must provide valid contact details for updates on visa/OK TO BOARD application status by WT.

User Responsibilities

By engaging WT for visa application facilitation, Users authorize WT to submit necessary visa applications, including visa fees and embassy charges, on their behalf to the concerned embassy. Users must promptly provide genuine documents required for visa processing to WT and ensure accuracy of all information provided. Users must furnish all necessary and accurate information to WT for visa processing, including name, address, contact details, travel destination, and other details as required by WT.

Upon WT’s return of passports and documents, Users must verify receipt of all necessary visas and ensure accuracy of visa details matching their travel itinerary. In case of visa rejection, Users wishing to reapply or appeal must instruct WT accordingly. Reapplication/appeal constitutes a new transaction, with Users liable for applicable fees to WT for these processes, including service fees. WT will not initiate reapplication unless instructed by the User.

Third-party vendors appointed by WT may decline to submit a User’s visa application based on their assessment of submission risks due to inadequate documentation. If additional documents are required, WT informs Users and submits applications only upon satisfactory document submission. In case of non-submission by the vendor, visa fees are refundable, but WT’s service fees are non-refundable.

Payments and Other Charges

WT charges a service fee for submitting visa applications on behalf of Users to embassies, in addition to visa fees, embassy charges, and other applicable fees. Users must pay this service fee to WT when engaging visa-related services. WT does not refund service fees under any circumstances, including User decisions not to submit visa applications or application rejections.

Logistics charges, such as document pick-up, passport collection, courier fees, or other costs incurred by WT beyond standard service scope, are payable separately by Users.

Embassy fees, taxes, and other charges beyond WT’s control may change without notice and are non-refundable after visa application submission, per embassy guidelines.

Outbound and Domestic Tours

Role of WT and Limitation of Liability WT does not operate or control airlines, shipping companies, coaches, hotels, transport vehicles, restaurants, or any other facilities/services listed in tour brochures.

WT is not liable for delays, inadequate service standards, or any injury, death, loss, or damage caused by actions or defaults of service providers or independent contractors (e.g., hotels, airlines, cruise operators) engaged by WT. WT bears no responsibility for actions or behavior of co-travelers/passengers that result in injury, property damage, or interfere with tour enjoyment.

    As a facilitator, WT is not liable for:
  • Personal injury, sickness, accidents, loss, delays, discomfort, or theft during travel.
  • Acts or defaults of travel agents, third parties, or their employees.
  • Loss or damage to baggage or personal belongings.
  • Service delays by service providers.
  • Airline failures to accommodate passengers despite confirmed tickets.
  • Disputes with tour managers.
  • Damages due to circumstances beyond WT’s control.

WT’s total liability for tour-related claims does not exceed the total booking amount paid by the User.

In exceptional circumstances (e.g., weather conditions, labor disputes, insolvency, government decisions), service operators (e.g., airlines, hotels) may be unable to honor confirmed bookings. WT will endeavor to offer alternative arrangements or refunds after reasonable service charges if supported by service providers and communicated in advance. This comprehensive rewrite maintains the essence of the original while enhancing readability and clarity.

Meals and Special Requests

Dining Arrangements Menus for meals during the Outbound Tour are predetermined and clearly outlined in the Brochure. WT does not accommodate requests for special meals or guarantee special dietary requirements unless explicitly mentioned in the brochure.

WT reserves the right to modify menus if circumstances necessitate such changes. If the User cannot avail a meal from the menu for any reason, WT will not entertain claims for the unutilized meal.

Hotels worldwide serve breakfast at varying local times specified in the confirmed booking voucher. Hotels do not offer breakfast room service; it must be consumed during serving hours. WT does not entertain claims for missed breakfasts due to any reason.

Upon discretion, WT may consider requests for special meals or room allocations, subject to confirmation by the respective service providers. WT endeavors to ensure these requests are honored but is not liable if they are not fulfilled. Any additional costs for special meals or requests must be borne by the User.

If WT fails to provide a meal through its fault, WT’s liability is limited to a proportionate refund of the amount paid by the User for that meal during Outbound Tour booking.

Hotels in the Outbound Tour

Accommodation Selection WT meticulously selects hotels for the Outbound Tour based on internal assessments, typically choosing top-rated options in their categories. WT strives to provide hotel details to Users in advance through proposed itineraries. However, WT reserves the right to change hotels before booking due to availability or other factors beyond its control.

Once the User selects a specific hotel category or star rating, WT does not entertain disputes regarding the star category or type of hotel.

WT is not liable for inconvenience or discomfort caused to Users due to insufficient hotel services. WT acts as a facilitator between Users and hotels and is not responsible for inadequate hotel services.

Users are accountable for any damages caused by themselves or accompanying guests to hotel property. The extent and compensation for damages are determined by the respective hotel, and WT does not intervene in such matters. Requests for hotel changes after confirmation will not be accommodated. If Users upgrade or change hotels independently, they agree to bear the associated charges without recourse to WT. Users are responsible for their baggage and valuables. WT bears no liability for loss or theft of Users’ belongings during hotel stays or throughout the tour.

Itinerary

Tour Plans WT provides a proposed itinerary to Users before booking. This itinerary is subject to changes. Final booking details and hotel vouchers provided to Users post full payment are considered final. The price of the Outbound Tour may increase without notice. In such cases, Users must pay the incremental cost before departure. Itinerary days and nights are determined based on hotel and airline availability. Claims for full utilization of the last day or tour inclusion are invalid. WT endeavors to finalize tour itineraries that prioritize User convenience and comfort. However, WT notifies Users of itinerary changes before tour departure.

WT is not responsible for any losses incurred by Users due to post-departure itinerary changes beyond WT’s control. WT may claim additional expenses resulting from itinerary delays or alterations due to any reason.

WT reserves the right to amend or substitute departures, excursions, hotels, or other aspects of the itinerary if deemed necessary.

No refunds are provided if Users miss tour activities due to personal delays. Requests to alter the itinerary after booking will not be entertained unless approved by WT, subject to availability. Users must cover any additional costs incurred due to such changes or cancellations.

Coach and Seating

Transportation Arrangements Coaches are used for transfers and local sightseeing during Outbound Tours. Seating is unassigned, and Users must follow instructions from the Tour Manager.

Users are advised not to leave valuable belongings on coaches when disembarking. WT is not liable for loss of such items from coaches. Users are responsible for their baggage and personal effects at all times.

Users are liable for any damage caused to coaches due to their actions. WT bears no responsibility for such damages.

Coach drivers adhere to specific rules regarding driving hours and rest periods. Users must adhere strictly to daily timetables to facilitate smooth travel. WT does not refund costs for missed sightseeing due to User-caused delays.

In the event of coach breakdown or transportation vehicle failure, WT provides an alternative promptly. WT is not responsible for delays caused by breakdowns, traffic, or other reasons affecting alternative vehicle provision.

Tipping

Tipping customs vary globally and are customary for services rendered (e.g., porters, coach drivers, guides). Tipping is at the User’s discretion unless otherwise specified in the brochure. In Europe, tipping is expected for services such as local guides, waiters, tour managers, and porters. Users must tip coach drivers a nominal amount of 2 Euros (Europe and UK) or 2 Dollars (USA) per person per day for the tour’s duration.

Currency and Traveler’s Cheques

Users are advised to carry local currency, traveler’s cheques, or a travel currency card. Traveler’s cheques are secure and replaceable if lost or stolen, provided Users have the cheque numbers and counterfoils.

A travel currency card offers the safest method to carry foreign currency, with 24/7 ATM access. Accommodation for Children Below 12 Children under 12 booked without separate bed payment will not receive a separate bed in hotels during the Outbound Tour. Bookings through Third Parties/Travel Agents

If a travel agent signs the booking form on behalf of Users, it implies Users’ authorization for the agent’s signature, binding Users to the booking.

For bookings through travel agents, the contract is between Users and their travel agent, with WT acting as the agent’s supplier.

Users must provide accurate contact information during booking. WT is not liable for claims due to non-receipt of information if the provided contact number is unreachable or does not belong to Users.

WT assumes no responsibility for promises made by authorized travel agents during bookings. All products and services adhere to WT’s brochures or documents provided during tour booking.

Refunds (if any) for bookings made through other travel agents will be processed through the authorized agent.

Forfeiture of Deposits

WT may require Users to pay a non-refundable, interest-free booking fee when booking the tour. If the User cancels the booking or fails to adhere to the tour payment schedule as specified in the documentation checklist, or if the visa for the destination country is not granted, or if the User is unable to travel due to personal reasons, including medical grounds or sickness, cancellation charges will apply as communicated by WT.

Users acknowledge that air tickets and hotel bookings for tours are made concurrently with visa processing to ensure availability as per the proposed itinerary. If a visa is denied, WT reserves the right to recover any costs incurred in making such bookings by deducting cancellation charges, as specified above. Users agree that these charges are fair and reasonable, covering expenses WT incurs for making and canceling bookings at the User’s request.

Cancellation Due to Visa Rejection

All Users traveling on an outbound tour must possess valid visas (including transit visas) for all countries they intend to visit or pass through as part of the tour

Users whose visas are not granted by the relevant consulates must promptly inform WT of the rejection. WT will deduct applicable cancellation charges and any additional visa expenses incurred, refunding any remaining balance.

If a User wishes to reapply or appeal against a visa rejection, WT will assist strictly according to the User’s instructions. Any reapplication or appeal will be treated as a new transaction, and the User is responsible for applicable fees and WT’s service charges. WT will not initiate visa reapplications unless instructed by the User.

Cancellation Charges

    If the Outbound Tour is canceled for any reason, including visa rejection or voluntary cancellation by the User, cancellation charges specified in the brochure or itinerary will apply. If not specified, the following cancellation charges will be applicable:
  • 45 days or more prior to departure: Booking fees
  • Between 44 and 31 days of departure: 25% of Tour Cost
  • Between 30 and 15 days of departure: 50% of Tour Cost
  • Between 14 and 8 days of departure: 75% of Tour Cost
  • Within 7 days prior to departure or no-show: 100% of Tour Cost

Payment of the Tour Cost

Payment must be made as per the schedule provided in the brochure, email, or any other documented information at the time of booking. Payments can be made online or by DD/cheque as specified.

Payments can be made in INR or any other specified foreign exchange/currency, depending on various outbound service providers and contractors involved in planning the OBT.

If any payment cheque is dishonored, WT reserves the right to cancel the entire booking without notice and pursue appropriate legal remedies.

Final documents and airline tickets will be issued to the User only after full payment to WT. A PAN Card copy is required for cash payments exceeding Rs. 25,000.

For the purpose of calculating tour costs or refunds, foreign exchange components will be based on the prevailing exchange rates. Fluctuations in exchange rates may result in changes to the tour cost or refund amount, and Users agree to bear any such differences.

Refunds

WT acts as a facilitator, and any refund for undelivered services by service providers or contractors is contingent upon WT receiving the refund from the service provider. Users acknowledge that WT is not responsible for delays or non-refund of amounts from these entities and should directly contact the service provider for any claims.

If Users make changes to their accommodation during the Outbound Tour, WT will not refund or compensate in any manner. Users are also liable for any additional costs arising from such changes.

In case of delays in refunds beyond the specified period, WT’s liability is limited to refunding the amount with interest calculated at the applicable bank rate until the refund date.

Amendments

If WT amends or alters a tour or holiday after booking, Users may choose to continue with the amended tour, accept an alternative tour offered by WT, or opt for a refund of the tour cost (after deducting actual expenses incurred by WT such as visa, insurance premium, and other applicable charges). WT is not liable for any damages, additional expenses, or consequential losses in such cases.

WT is not obligated to provide a breakdown of the invoice for each service included in the package under any circumstance.

Promotions & Discounts

WT may periodically introduce promotional offers and discounts on tour packages, whether through internal channels or external advertisements. Some Users on group tours may receive additional benefits based on their entitlement to these promotions and discounts. Users in the group cannot claim these privileges if they are not eligible or entitled under the promotion.

If WT publishes any travel scheme offering discounts or benefits, WT reserves the sole right to withdraw such schemes or discounts at any time.

Tour Arrangements & Other Activities

For tour arrangements such as carnivals, cosmos tours, star cruises, amusement parks, museums, etc., the terms and conditions specified by these respective entities will also apply.

Users are responsible for arriving at the tour’s starting point and registering with WT’s representative, tour guide, or tour manager at the designated place, date, and time.

If a User utilizes pre-tour services or part of them, including air tickets (included in the main tour cost), but fails to join the main tour group at the designated place or cancels the tour after using these services, it will be considered a “no-show,” and there will be no refund for the unused pre-tour or main tour services.

WT cannot be held responsible for any risks to the health, safety, or well-being of Users during activities such as adventure sports, amusement park rides, ferry rides, sightseeing, or any other potentially hazardous activities undertaken as part of or independently during the Outbound Tour. Any loss, injury, accident, or other incidents arising from such activities are solely at the User’s risk and liability attributable to WT.
